Terms of Service

By downloading, installing, or using the Cresco application ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms apply to all users of the Service, including users with a free account and users with a paid subscription.

Cresco is an AI-powered gardening assistant that helps you track plants, generate personalised pruning schedules, identify plant species from photos, and receive weather-based care advice. Features vary between free and Pro tiers.

To use the Service you must create an account using a valid email address or a supported third-party authentication provider (e.g. Google). You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at info+cresco@noproblem.software if you suspect any unauthorised use.

Cresco offers a free tier and a paid "Cresco Pro" subscription. Subscriptions are billed on a recurring basis (monthly or annually) at the price shown at the time of purchase. Payments are processed by third-party providers (App Store, Google Play, or Stripe). All fees are non-refundable except where required by applicable law.

You may cancel your subscription at any time through the platform where you originally subscribed. Cancellation takes effect at the end of the current billing period; you will retain access to Pro features until that date.

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms.
• Attempt to reverse-engineer, decompile, or extract the source code of the Service.
• Use automated means to access or scrape the Service.
• Upload content that is illegal, harmful, or infringes the rights of others.
• Impersonate any person or entity or misrepresent your affiliation.

Cresco uses AI to generate pruning schedules, plant identifications, and care advice. This content is provided for informational and advisory purposes only. It is not a substitute for professional horticultural advice.

Plant care outcomes depend on many factors outside our control — including the specific variety, age, and health of your plant, local soil conditions, microclimate, pruning technique, and timing. Because every garden and situation is different, Cresco cannot guarantee that any recommendation will produce a specific result.

Cresco accepts no responsibility or liability for any damage to, deterioration of, or death of any plant resulting from following, misinterpreting, or misapplying advice generated by the Service. You act on all recommendations at your own risk and remain solely responsible for the care of your plants.

If you are unsure about a pruning action, we recommend consulting a qualified horticulturalist or local garden centre before proceeding.

You retain ownership of any photos, plant names, and other data you submit to the Service ("User Content"). By submitting User Content, you grant Cresco a worldwide, royalty-free licence to use, store, and process that content solely to provide and improve the Service. We will not sell your User Content to third parties.

All rights, title, and interest in and to the Service (excluding User Content) are and will remain the exclusive property of No Problem Software and its licensors. Nothing in these Terms grants you a right to use the Cresco name, logo, or other brand elements.

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

In particular, Cresco makes no warranty that:

• Any pruning schedule or care advice is accurate, complete, or appropriate for your specific plant, variety, or growing conditions;
• Following advice generated by the Service will result in a healthy, thriving plant;
• Plant identifications are correct in all cases.

Gardening involves inherent risks. The Service is designed to assist and inform, not to replace your own judgement or professional expertise.

To the maximum extent permitted by applicable law, Cresco and No Problem Software shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of or inability to use the Service.

Without limiting the above, Cresco expressly excludes all liability for:

• The death, damage, or deterioration of any plant following advice provided by the Service;
• Incorrect plant identification;
• Pruning carried out at an unsuitable time or in an unsuitable manner based on a recommendation from the Service;
• Any loss — financial or otherwise — resulting from acting on AI-generated content.

Where liability cannot be excluded by law, our total liability to you shall not exceed the amount you paid to us in the 12 months preceding the claim.

We may suspend or terminate your account at any time if we reasonably believe you have violated these Terms, without prior notice or liability. You may terminate your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately.

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. If the changes are material, we will notify you by email or in-app notification. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.

These Terms are governed by and construed in accordance with the laws of the Netherlands, without regard to conflict-of-law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts located in the Netherlands.
